Rules and Regulations

General terms of use

• Accepting the rules and regulations is required for membership in Whiskey Mountain Wars (WMW) and using the forums.
• WMW is a free online game and the WMW team is not liable or responsible in any way for lost data, availability of the game or other factors that may inhibit or influence the quality of the game outside of issues the WMW team can control or fix.
• The WMW team reserves the right to suspend the game at any time for one of the following reasons:
1. No technical capability of further maintaining the service
2. No financial resources available to maintain the service
3. No premium accounts on a server
4. Other external factors that make it impossible for the WMW team to maintain the service including legal issues.
• All accounts including items, equipment, ect are virtual objects of the game. The user does not obtain ownership or any other rights to items in an account. All rights are reserved by the WMW team. No rights, in particular no exploitation rights are assigned to the user. It is prohibited to sell the objects in game to third parties or to lay claim of said objects unless written consent is given by the WMW team.
• Final and free of charge exchange of accounts between a user to third parties or between user and user is allowed as long as all parties involved agree to the transfer. The WMW reserves the right to be informed of such an exchange between accounts.

Age Restrictions and information:
The WMW team requires users to be at an age where they can read and understand the text in the site but there is no set age requirement. Themes present in this online game are mildly violent but there is no blood or gore shown, all of it happens in the background. Another constant theme is illegal whiskey running.
WMW does not take responsibility for any child playing our game without a parent's consent if the parent does find the game too violent. The WMW team believes that our game can be played by anyone as long as they are mature enough to understand the in game textual content.
The WMW team will take into consideration the age presented during registration and question an age that seems 'too young' as determined by administration and take action at the discretion of the administration.

Registration and prohibited actions:
Membership begins once the account a user creates is activated. Administrators reserve the right to decline membership to WMW and the WMW forums if:

• The applicant has previously been expelled due to breaking the Rules and Guidelines.
• The application breaks the Rules and Guidelines in any way.
• The WMW team has technical problems and cannot accept the application in connection with server capacity issues.

PROHIBITED ACTIONS:

• Obscene words are prohibited in usernames and profile information. False identification and hacking another player's account is also prohibited.
• Copyrighted or trademarked material is prohibited and is considered outside advertising.
• Real world contact information (telephone numbers, addresses, full names) are prohibited for public display. This information can be given out at a users discretion but is prohibited for wide spread posting on profiles.
• False information or advertising illegal activities are prohibited on a user's profile.
• Multiple registrations are allowed on one server but excessive multiple registrations (5+) are prohibited and grounds for immediate account deletion.
• Players blocking or by-passing Administrator 'banning' or e-mail by deleting a character and creating a new one will be permanently banned and have the new account deleted without notification or form of recourse.
• It is prohibited to use any mechanism or software in connection with the game that interferes with the operations of the server in any way than allowed by the WMW team.
• Interfering with communication between administration and users is prohibited. Usurping an administrator's identity and using it for personal gain or to interfere with the game is prohibited.
• Using WMW and its services outside a web browser is prohibited.
• Any botting device or other automatic substitution or updating device is strictly prohibited.
• Exploiting server errors or programming errors for personal gain is prohibited. In the case of an error, it is to be reported to administration immediately with as much information as possible so the WMW can repair the error.
• Any actions preventing or hindering another user's game play is prohibited.
• Premium accounts and game coins are of material value and exchanging them for in game favors or game virtual values are strictly prohibited.
• One account being used by more then one player constantly (account sitting) is prohibited. It is also prohibited to share an account password with third parties. The WMW team will not ask for passwords and does not take responsibility for damage caused by deliberate or non deliberate sharing of account passwords.

IN GAME FREEDOM OF SPEECH:

Any prohibited action can result in a warning or ban dependant of the level of severity of that action. Multiple bans will result in permanent denied access to WMW and the WMW forums. Prohibited actions outlined above also apply to in game communication.

• The WMW team provides users with multiple platforms of communication: forums, in game chat and in game message system. The users are responsible for the contents of any form of communication.
• The WMW team is not responsible for any offensive or law-breaking contents but offensive or law-breaking contents are not allowed. Players who use offensive language will be awarded with a warning or ban and possible termination of the account.
• It is prohibited to send mass communication beyond which the game can allow.
• Advertising other sites and games are also prohibited without consent of the WMW team.
• Sending messages in other languages besides the translated language of a server is prohibited and will be awarded with a ban. This is also extended to extremely excessive use of text talk.
• Personal attacks, intended violence outside of game play, and hate speech against other players is strictly prohibited and will be awarded with a ban dependant on the extent of the personal attack, intended violence outside of game play and level of hate speech.
• Misquoting or misrepresenting other players in messages for personal gain is prohibited and will be awarded with a warning or ban dependant on the damages caused.
• Deliberate, continuous, and harmful exclusions of certain players based on: race, religion, personal ethics, location, gender, preferences or tastes is strictly prohibited and will be awarded with a warning or ban depending on level of exclusion.
• Indecent, racist, offensive, copyrighted, illegal, graphically violent, graphically sexual, and exploitation images or material is forbidden. Any other images or materials that are otherwise objectionable or exploit any member of a group are also prohibited.

FORUM FREEDOM OF SPEECH:

Prohibited actions can result in a warning from administration or moderators. Three warnings results in a banning of that forum account. Multiple banned forum accounts can result in a ban in game. Excessive bans in game can also result in a ban on the forums. Any prohibited actions as outlined under the IN GAME FREEDOM OF SPEECH or under PROHIBITED ACTIONS applies to forums. The following actions are also prohibited:

• Excessive subsequent posting.
• Excessive off-topic posting.
• Necro-posting as defined as posting in a thread that has not had any new posts in over 6 months. These types of threads are considered 'dead' threads and are only present in forums for the information provided in the thread. Threads that are considered 'dead threads' may be revived if the information posted is relevant and important to the thread.
• Copying the topic, topic title, or discussion in an all ready present and active thread. A single user posting multiple threads that are exactly the same in a small window of time.
• Any post or topic which can be taken as 'spam' or 'trolling'. Spamming is defined as posting nonsensical remarks which have no relation to the topic and possibly do not make sense. Trolling is defined as deliberately provoking other players on a controversial topic or deliberately trying to anger the player base.
• Discussion of illegal activity (excluding whiskey running in game) or questionable activity (getting around copyrights, hacking ect.)
• Violating copyrights, trademarks, patents and trade secrets.
• Irritating post styles including: ALL CAPS CONSISTENTLY, bright or excessive colors, multiple images, annoying flashing text or images in post style or any post style that takes up too much room.
• Irritating or offensive forum signatures including bright or excessive colors, multiple images, annoying flashing text or images or any signature that takes up too much room or does not meet size requirements outlined.
• Any avatar that consists of annoyingly flashing or changing images, offensive material or an avatar image that does not meet size requirements outlined.
• Consistent use of extremely excessive text-talk, languages other then what the server translates in, or any other language that the forum can not understand.
• 'Hit and run' posting: defined as posting a single link/word/image with no explanation. This does not constitute as a valid post unless the topic of the thread allows it.
• Self-promotion or self-advertising of services, books, images, music, or other materials.
• Filing a false report on another player.
• Misquoting or misrepresenting another player or changing a player's quotes once quoted for personal gain.

Termination of an account: The WMW team reserves the right to terminate any inactive account after a year of inactivity. This one year time period does not begin for premium accounts until the premium time on the premium account ends.
The WMW team reserves the right to delete or block accounts without notification or warning, mainly but not exclusive, in case of violation of the rules and guidelines. A player has no legal claim over such an account since WMW is considered a free to play game.
An account can only be terminated by not logging in for a year; there is no deletion of accounts for any level or for any price. If a user wishing to stop playing, they simply stop logging in.
Administration is entitled to block or ban accounts permanently in the case of violating the Rules and Guidelines. Duration and extent of the block or ban is determined by the administration.

Premium Accounts: If a user pays for a premium account, they automatically receive all the benefits as outlined in the premium package. Special attention will be given to premium account users in the case of editing premium accounts or suspending them.
The premium user is not entitled to any rights not outlined in the Rules and Guidelines. Premium players must still follow the Rules and Guidelines just as a non-premium player does.
The only time a user can claim refunds is if the user is terminated by the WMW team but did not violate the Rules and Guidelines. The user is not entitled to a refund if the user violates the Rules and Guidelines or the law and the account is terminated.

Data Protection:

• The WMW team reserves the right to personal data including: IP addresses, e-mail address, data given during registration, and registration date. This data is stored to uphold the Rules and Guidelines. The player is allowed to change or delete this data but deleting a registration date results in deleting an account and the inability to log in.
• The WMW team reserves the right to gather, store and process detailed information on the user pertaining to the game. This information includes: logging in, in game actions alongside with time and parameters transferred to the came. In the case of blocking or deleting a user account data will be erased unless it causes the WMW have any losses. In this case the WMW team reserves the use of this information in civil court if such actions are needed.
• Once an account is deleted all personal information will be erased.
• The WMW team reserves the right to process user's data for marketing purposes. The WMW team also reserves the right to disclose this information to authorities if the user has been found to be participating in proven illegal activity.

Liability: The WMW team is not liable for any damage caused directly or indirectly by using the WMW services, the game or the game forum. In any case of liability of the WMW team to the users, the service cannot exceed sum of all payments made to use this service.

Modifications to Rules and Guidelines:
The WMW team reserves the right to modify the Rules and Regulations as needed. Any information changed or added will be placed on the websites and the forums one week in advance. Information on crucial modifications in the rules will be placed on the WMW website and/or game forums no later than one day before introducing them.
If the modification is only to repair a bug or problem in the game, the WMW team reserves the right to immediately modify it without notifying the users.
If modifications occur, logging into the game is equal to accepting the new modifications.

Technical Requirements:

• Newest version of any web browser: Internet Explorer, Firefox, Safari, or Opera.
• OS class of Windows or UNIX and a stable version of a web browser mentioned above.
• Internet connection that allows the web browser to communicate through http protocol with the networks.
• A computer that allows the usage of the above three points.
• Enabled and properly functioning JavaScript and cookies option.

Procedure of complaints:
Complaints can be placed on the game forum. In particular:

• Information regarding bans or termination and the duration of a ban will be shown on the banned players log-in screen and be mentioned in the forums. In the case of no explanation of a termination or ban, players may post a complaint and this complaint will be responded to within 3 business days.
• Complaints regarding premium accounts may be placed through sending a private message to the appropriate WMW team member. The complaint will be looked at within 3 business days.
• Complaints regarding technical problems with the game can be posted in the sub-forum 'Bugs'. WMW has tested the game on the configuration mentioned in technical requirements and does not guarantee compatibility of the service with equipment and programs not mentioned in technical requirements. WMW team does not have the technical means to state why the service will not work on a particular user's computer. WMW will do some troubleshooting methods and will check if the service is working correctly but cannot guarantee that a problem can be resolved if the technical requirements are not met.
• WMW reserves the right not to answer any questions or complaints that are mentioned in the F.A.Q section.

Possible Health damage warning:
WMW team warns that excessive use of this service (or any computer game) especially for people suffering from epilepsy may be harmful to a person's health.
If you or your immediate family playing this game has epilepsy the WMW team strongly recommends that the user consults their doctor before registration.
It is advised that children should use the computer in the care of a legal adult.
If any of the following symptoms (or worrying symptoms not listed) occur while using this game (or the computer), turn it off immediately and call a doctor:

• Suffocation
• Vision disorder
• Convulsions
• Loss of consciousness
• Difficulty with keeping balance
• Labyrinth disorder

Other: In cases not included in these Rules and Guidelines, Canadian law is applicable.
